What out-of-network billing means
When a provider does not have a contract with a patient's insurance plan, services are billed as out-of-network (OON). Without a negotiated fee schedule, the payer decides how much to reimburse, often based on its own definition of usual and customary rates. That is where revenue is won or lost.
Emergency rooms, hospitalists, anesthesiologists, radiologists, and urgent care facilities encounter OON claims constantly because patients cannot choose their provider in an emergency. These claims require a different approach than standard in-network billing.
The No Surprises Act
Since January 2022, the federal No Surprises Act limits what patients can be billed for emergency services and certain non-emergency services at in-network facilities. Patients pay only their in-network cost sharing; the remaining amount is settled between the provider and the payer.
If the provider disagrees with the payer's initial payment, the law provides a 30-day open negotiation period followed by Independent Dispute Resolution (IDR). Providers who understand and use this process consistently recover more than those who accept the first payment.

The second mistake is missing the negotiation and IDR deadlines, which are strict. The third is billing patients for balances the law prohibits, which creates compliance exposure.
